The present Terms and Conditions determine the sale of all products offered on our website www.mine4sure.com Placing an order is deemed acceptance of our Terms and Conditions. The sale contract is subject to French law. 1. OUR OFFER Our products, services and delivery terms, as indicated in the chosen currency (Pound Sterling or Euro), are valid worldwide. When placing an order, you accept the prices and product descriptions available for sale. However a slight difference may occur with regards to the colours, drawings and fonts shown on our website www.mine4sure.com. 2. PRICES Our prices are indicated in Pound Sterling or Euro and include current French V.A.T. Please note that any changes to the V.A.T rate could be immediately applied to our prices. Our prices include the standard delivery cost worldwide. Our prices are guaranteed until 31 December 2009. 3. YOUR ORDER Your online order is only registered when you have fully and clearly completed the order form available on our website. Within an hour of validating your order online, you will receive an email confirming reception. 4. ACCEPTANCE AND ORDER CONFIRMATION mine4sure will confirm your order by an automatically issued email within an hour of receipt. You can also print your order summary. mine4sure archives its customers orders on a computerised system. Our customers can access these files on written request to mine4sure. A sales contract is valid from receipt of payment for your order by mine4sure. 5. PAYMENT • By debit or credit card: When validating your order, please enter your credit/debit card number and its expiry date. Various accesses to authorisation servers are performed in order to check information and avoid fraud and abuses. Therefore, the server is on an encrypted mode and all information carried is coded (protocol). No information transits in clear mode on the internet. In accordance to the French Law of 13 March 2000 on electronic signature, the online transmission of your card number and final confirmation of your order are proof of completion of your order and therefore your liabilities to the due sums in payment of that order. • By bank transfer : The emailed order confirmation that you will receive contains the necessary details of our bank account to establish the bank transfer as well as your order number. Please mention this number in the bank transfer wording. 6. THE DELIVERY The prices of the products mentioned on our website www.mine4sure.com include delivery. The order processing time is the maximum time in which mine4sure commits to sending out the orders. It does not include the delivery time taken by the postal services or other transporters used. The order processing time can be reduced to 2 working days by using our express order processing system at the extra cost of 5€ or £5 per order. Your orders can be delivered to your home address or any other address. If it is a gift, please choose the option when ordering (at no extra cost) and indicate the delivery address. 7. RETURNS POLICY Defective items must be returned to us within 7 days from receipt. If the error is our responsibility mine4sure will replace the goods immediately and the cost of returning the products will be compensated by the shipping of extra labels. In accordance to the article L. 121-20-2 of the French Consumer legislation, your right of retraction cannot be exercised for the supply of personalised goods or those manufactured according to the customers specifications. 8. PRIVACY POLICY To take your order into account, it is necessary for us to collect your personal details. By giving us your email address you agree to receive confirmation of your order and receive information on our special offers and events via Internet. According to the French Law dated 6 January 1978 on data protection, you have a right to access, modify, amend and remove your personal details. To exercise this right, simply write to us specifying your name, address and email address. 9. INTELLECTUAL PROPERTY mine4sure is a registered trademark and the mine4sure labels have been patented. The site user who has his own personal website and wishes to place a simple direct link to the Home page of the mine4sure website must request prior consent to do so from mine4sure. Under no circumstances, will it imply a contractual agreement. mine4sure reserves the right to refuse all links and to require the withdrawal at any time of any link, even if tacitly authorised. 10. ENTIRE AGREEMENT Should one of the provisions of the Terms and Conditions be found unenforceable or invalid by a change in the legislation, regulations or by a court of justice, all other provisions in the Terms and Conditions will remain in full force and effect. 11. DURATION The present terms and conditions apply for the whole duration of the mine4sure products being online. 12. LIABILITY Under no circumstances, can mine4sure be deemed liable for any loss, damages or inconvenience caused by the use of Internet, such as breakdown in communication, presence of viruses, or unauthorised use or access and all cases qualified as “force majeure” by law. 13. DISPUTES Any dispute will be solved amicably as far as possible. Failing this, any litigation shall be submitted to arbitration in the relevant tribunal in Pau France.
